Mottow Soundz terms and conditions
Online consumer sales
Effective 13 October 2026
These terms explain how to order physical records, CDs, merchandise and digital music downloads from the Mottow Soundz online shop, and what to do if you need to cancel an order, return an item or report a problem. Section 10 applies whenever a product is offered as a download.

2 Scope and applicable terms
These terms apply when you buy as a consumer for purposes outside your trade or profession. They cover physical goods and digital music downloads sold directly through this shop. Separate terms apply to audio engineering services, vehicle hire and purchases made through third-party shops. Contact us about trade or wholesale orders.
The version provided when you place your order applies to that order. Later changes apply only to later purchases. Nothing in these terms limits rights that the law gives you.
3 Products and prices
The product page identifies the release, format, edition and selected variant. Please check these details before ordering. Printed colours and individual coloured-vinyl patterns may vary slightly from photographs; this does not excuse a wrong edition, a material difference from the description or a defective product.
Prices are in euros and include applicable VAT for the delivery destination. Delivery charges and any other charges collected by us are shown before payment. The total displayed before you place the order is the amount payable to us.
For physical goods delivered outside the EU, import VAT, customs duties and carrier clearance charges may be payable by you if they are not collected at checkout. Where applicable, we disclose this before the order is placed. We cannot determine the exact amount for every destination.
4 Orders and payment
You can review the products, quantities, delivery details and total before placing your order. The final order button makes clear that you are committing to pay. Payment is made using a method offered at checkout; payment is due when ordering, including for preorders.
We accept your order when we email you an order confirmation. A payment-provider receipt alone is not our acceptance. Your confirmation records the order details and payment information. A separate shipping email follows when the parcel is dispatched, identifying the delivery service and providing tracking where the chosen service supports it.
If a stock or listing error prevents fulfilment, we will contact you promptly. We will not substitute a product or increase the agreed price without your agreement. If an order cannot be fulfilled, any payment for the unfulfilled part and related delivery charges will be refunded without undue delay.
5 Preorders
A preorder reserves a release before it is ready to ship. The product page states that it is a preorder and gives the expected dispatch period and agreed delivery timeframe before payment. A release date is not necessarily the dispatch or arrival date.
If an order contains both available physical items and a preorder expected to be ready for dispatch more than three weeks after the order date, we dispatch the available items first and send the preorder separately when ready. If the preorder is expected to be ready within three weeks, the items ship together when it is ready. The arrangement and delivery timeframes are shown before payment. The original delivery charge covers both shipments, with no additional charge for splitting the order.
If production or release timing changes, we will explain the delay and provide revised timing. An update does not automatically extend an agreed delivery deadline or remove your cancellation rights. You can notify us that you wish to withdraw before delivery; the normal withdrawal period for goods runs from receipt, as explained below.
6 Delivery of physical goods
Available destinations, delivery methods, charges and delivery timeframes are presented before you order. We deliver within the agreed timeframe. Unless a different period has been expressly agreed, delivery must take place within 30 days of the contract being concluded.
If we miss the deadline, you may require delivery within an additional period appropriate to the circumstances. If we still fail to deliver, you may end the contract and receive a refund without undue delay. No additional period is needed if we refuse delivery or timely delivery was essential in the circumstances or you told us before ordering that a particular deadline was essential.
For delivery methods we offer, we remain responsible for loss or damage until you, or a person you designate other than the carrier, physically receive the goods. Choosing an untracked service does not remove those rights. If you independently arrange a carrier we did not offer, the legal risk-transfer rules for that arrangement apply.
Contact info@mottowsoundz.com if a parcel is missing, damaged or contains the wrong item. Photos of the packaging and item can help us resolve the problem. Please keep the packaging where practical; this is not a condition for exercising your statutory rights.
7 Changing your mind about physical goods
You may withdraw from an online purchase of physical goods without giving a reason within 14 calendar days after the day you, or a person you designate other than the carrier, receive the goods. For several goods ordered together but delivered separately, this period runs from receipt of the last good. The exception for unsealed recordings in section 8 applies. Digital downloads are covered by section 10.
To withdraw, send a clear statement to info@mottowsoundz.com or to our business address in section 1 before the deadline. You may use the model form below, but it is optional. Include enough information to identify your order. You can also use our online withdrawal form; an online submission is acknowledged by email. You do not need our prior permission to exercise your right.
Send the goods to the return address in section 1 within 14 days after notifying us. You pay the direct cost of a change-of-mind return. This does not apply to returns needed because goods are faulty, incorrect or damaged before delivery, for which we bear the costs required by law.
Pack items carefully, including sleeves, inserts and other supplied components. You may inspect goods as necessary to establish their nature, characteristics and functioning. You are responsible only for loss of value caused by handling beyond what is necessary, subject to the law. We do not charge a standard restocking fee.
If you withdraw from the whole order, we refund the payments received, including the cost of the least expensive standard delivery option we offered. Any extra cost of a premium delivery choice is not refundable. For a partial return, we refund the returned goods and any delivery charge attributable solely to them; charges for delivering retained goods remain payable, subject to your legal rights.
We refund within 14 days after being informed of your withdrawal. For goods, we may withhold payment until we receive them or you provide evidence that you sent them back, whichever happens first, unless we have offered to collect them. Refunds use the original payment method unless you expressly agree otherwise, without a refund fee.
8 Sealed records and CDs
The change-of-mind withdrawal right does not apply to sealed audio recordings, including vinyl records and CDs, once you have broken their seal after delivery. Opening the outer postal carton alone does not trigger this exception. Where an item was supplied without a seal, we do not rely on this exception.
This rule does not remove your rights if a record or CD is faulty, damaged or different from what you ordered, even if the seal has been opened.
9 Faulty goods and legal guarantee
New physical goods benefit from the applicable Belgian statutory conformity guarantee, normally for two years from delivery. Contact us as soon as you discover a defect. The applicable legal rules on proof apply. Physical media used solely to carry digital content are subject to the digital-content guarantee rules described in section 10.
You may request repair or replacement free of charge, subject to legal feasibility and proportionality rules. The remedy must be provided within a reasonable time without significant inconvenience. Where the legal conditions are met, including refusal, an unsuccessful remedy, serious non-conformity or inability to remedy in time, you may obtain a price reduction or terminate the sale for a refund. Termination is unavailable for a merely minor defect.
Necessary postage and other remedy costs are borne by us. Normal wear or damage caused by misuse is not a manufacturing or conformity defect. These terms do not restrict any other mandatory rights.
10 Digital downloads
A download purchase supplies digital audio files. A physical record or CD is included only if the product description says so. Before ordering, you can see the file format, relevant audio specifications, compatibility requirements, delivery method and availability date, and any download limits or technical restrictions. Downloads carry no postal delivery charge.
Available downloads are supplied without undue delay after payment, subject to the withdrawal arrangements below. For a digital preorder, the stated availability date applies. You need an internet connection, sufficient storage and compatible software. Contact info@mottowsoundz.com if the link or files fail; technical trouble does not remove your statutory rights.
Your purchase gives you a non-exclusive right to download and use the music for personal, non-commercial listening. You may keep personal backup copies where permitted by law. The purchase does not authorise uploading or distributing the files to others, commercial exploitation or public use requiring a separate licence. Statutory copyright exceptions remain unaffected.
For digital content not supplied on a physical medium, the normal withdrawal period is 14 calendar days from conclusion of the contract. If you want supply to begin within that period, we ask separately for your express consent and your acknowledgment that you will lose the withdrawal right once supply begins. We confirm the contract, consent and acknowledgment by email before starting supply. Only when all legal conditions are met does that withdrawal right end. If you do not give this consent, supply starts after the withdrawal period or on a later agreed availability date.
While the right remains available, you can withdraw using the contact details, clear-statement method or online withdrawal function described in section 7, without returning a physical item. The applicable refund is made within 14 days of notification, using the original payment method unless you agree otherwise, without a refund fee. Consent to digital supply does not, by itself, waive withdrawal rights for a physical record or CD bought in the same order.
Downloads must meet the description and legal conformity requirements. Single-supply downloads benefit from the Belgian two-year legal guarantee from supply; the statutory presumption that a defect existed at supply normally applies during the first year. We provide any legally required updates and instructions. If content is faulty, you may require us to bring it into conformity free of charge within a reasonable time and without significant inconvenience. Where the legal conditions are met, you may obtain a proportionate price reduction or terminate the digital contract for a refund; a merely minor defect does not justify termination of a paid digital contract.
If we fail to supply a download, you may call on us to supply it and terminate if we do not do so without undue delay or within an expressly agreed additional period. You need not wait where the law permits immediate termination, including refusal to supply or a missed essential deadline. Losing a change-of-mind withdrawal right does not remove remedies for non-supply or defective content.
11 Complaints and disputes
Please send complaints to info@mottowsoundz.com with your order reference and a description of the problem. We will examine the complaint and work with you towards a solution.
If a dispute remains unresolved after you have contacted us, you may seek assistance from the Belgian Consumer Mediation Service: Boulevard du Roi Albert II 8, box 1, 1000 Brussels; contact@mediationconsommateur.be; +32 2 702 52 20; mediationconsommateur.be. This does not prevent you from using the courts or other remedies available by law.
Belgian law applies. If you are a consumer resident in another country, this choice does not deprive you of mandatory protections that apply under the relevant conflict-of-law rules. Court jurisdiction is determined by the applicable law; these terms do not require consumers to bring all claims exclusively in Brussels.
12 Personal data and website content
We use customer data to process orders, arrange delivery, provide customer service and meet legal obligations. For questions about your personal data, contact info@mottowsoundz.com. Buying from us does not itself constitute consent to marketing.
Buying a physical release does not transfer copyright in the recordings or artwork. Any use requiring permission under copyright law remains subject to that permission. Uses permitted by law remain unaffected.

Complete and send this form only if you wish to withdraw from your purchase. You may instead send any clear statement of your decision. No reason is required.
